c. Agreement to Arbitrate Claims; Waiver of Jury Trial

You and Varsity agree that, except as otherwise provided in this section, any dispute, claim, or controversy shall be resolved by binding arbitration rather than in court, and you and Varsity each waive the right to a trial by jury. Before initiating arbitration, the party raising a dispute must first send written notice of the dispute to the other party. The notice must (i) describe the nature and basis of the claim or dispute, and (ii) set forth the specific relief sought. If the dispute is not resolved within sixty (60) days after the notice is received, either party may commence an arbitration proceeding.

Any cause of action or claim you may have arising out of or relating to these Terms of Use or the Website must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
